Purpose and scope
IP Link Telecom, Inc. (“IP Link”) has formulated this Acceptable Use Policy (“AUP”) to promote responsible use of our networks, systems, services, websites, products, software, and platforms by our customers and other users (collectively, “Users”). This AUP is designed to protect IP Link, its customers, and the community from fraud, abuse of resources, and irresponsible or illegal activities.
For purposes of this AUP, “IP Link” includes IP Link Telecom, Inc., its affiliates, successors and assigns, and third-party service providers with whom IP Link contracts. The protections in this AUP extend to each such entity, and IP Link may empower them to enforce any provision of this AUP.
Monitoring and cooperation
To help ensure compliance, IP Link may, in its sole discretion and as permitted by law, monitor a User’s use of the services, including reviewing data and information available on IP Link systems. IP Link may provide data to, and report the identity of customers engaged in activities that are or appear to be illegal to, law enforcement or other governmental authorities.
IP Link may cooperate with law enforcement and governmental authorities as necessary to satisfy applicable laws, regulations, legal process, and valid governmental requests.
User responsibilities
Users must use IP Link services and any related software or platforms in a manner consistent with all applicable laws and regulations. Customers are responsible for the actions and usage of their retail end users, wholesale customers, contractors, agents, and other persons who access IP Link services through them.
The following list identifies prohibited activities. It is illustrative and not exhaustive.
- Unlawfully transmitting, distributing, displaying, or storing copyrighted material or otherwise infringing the intellectual-property rights of another person.
- Using IP Link products or services to violate the law, aid an unlawful act, or acquire, transmit, or develop information designated by a government as sensitive or relating to national security.
- Transmitting, distributing, redirecting, or storing material that IP Link reasonably determines is obscene, defamatory, libelous, threatening, abusive, hateful, or that contains or incites violence.
- Interfering with another user, host, service, network, the Internet, or the Public Switched Telephone Network (“PSTN”).
- Scanning, probing, penetration testing, or other security testing or information-gathering activity without IP Link’s prior express written consent.
- Distributing software, programs, telephone calls, or messages that may cause damage, disruption, or unreasonable annoyance to people, data, systems, or networks.
- Sending unsolicited bulk email or messages, using IP Link systems as a mail drop or name server for spam, attempting to bypass filters, or operating an affiliate program in a manner that produces prohibited traffic.
- Engaging in fraud, intentional misrepresentation, misleading calls or messages, phishing, obtaining services with the intent to avoid payment, or facilitating any fraudulent scheme.
- Accessing or attempting to access another person’s computers, accounts, networks, or resources without authorization; attempting to defeat security controls; or using services not included in the customer’s agreement.
- Overloading, disabling, or materially encumbering a service, host, processor, storage resource, or network, or interfering with another person’s use of IP Link services.
- Causing IP addresses, numbers, domains, messaging campaigns, or other resources to be blacklisted and failing to remedy the condition within forty-eight (48) hours after notice.
- Using viruses, worms, time bombs, corrupted files, Trojan horses, or code designed to disrupt, damage, overburden, impair, or limit software, hardware, networks, servers, or communications equipment.
- Using robots, spiders, automated dial-in tools, automated inquiry devices, or other programmatic means to obtain information from, monitor, or copy the IP Link website, products, or services without permission.
- Disabling, bypassing, modifying, defeating, or circumventing digital-rights-management tools or security controls used by IP Link.
- Reproducing, duplicating, copying, selling, trading, reselling, or commercially exploiting any unauthorized portion of the IP Link website, content, services, or access to them.
- Systematically collecting or using content through data mining, scraping, or similar extraction methods without authorization.
Enforcement
If IP Link reasonably believes a User has violated this AUP, IP Link may take any action it considers appropriate, including notifying the User, requesting information or confirmation regarding mitigation efforts, blocking traffic, suspending services, or terminating the account. These actions are in addition to any other remedies available to IP Link.
A violation may result, without prior notice or warning where appropriate, in suspension, termination, loss of refunds or rebates, and continued responsibility for amounts owed. IP Link may pursue reimbursement of costs incurred to investigate, mitigate, or enforce compliance and collection.
Content, networks, and third parties
Except where required by law or necessary for network management or administration, IP Link does not undertake to monitor or restrict all content. Users accept responsibility and risk for content they access or use and for their use of the Internet, telephone networks, and services accessed through IP Link arrangements.
Users are solely responsible for following the permission and usage policies of every network, computing resource, service, platform, or third-party offering they access through IP Link services, including telephone networks, email, file transfer, web access, and Internet postings.
Indemnification and ownership
Each User agrees to indemnify and hold harmless IP Link from claims resulting from the User’s use of IP Link services or arrangements and from use by others when the User knowingly permitted, facilitated, or accommodated that use.
All services, arrangements, and associated intellectual property, including copyrights and trade secrets, remain the property of IP Link or its licensors. Exclusive title and associated rights remain with IP Link or its licensors.
Service and data limitations
IP Link is not responsible for the accuracy, quality, or content of information obtained through IP Link services, or for damages arising from service interruptions or anomalies, including interruptions or anomalies resulting from periodic maintenance.
Users are responsible for maintaining separate duplicate or backup files, messages, records, and directories. IP Link does not guarantee continued storage of data placed on IP Link or underlying-provider systems and may impose storage limits or remove material that violates this AUP or exceeds established limitations.
Governmental requests
IP Link may be required to collect information about service usage, monitor activities, or submit User information to law enforcement or governmental authorities. IP Link will respond to such requests in accordance with applicable law and may, in its discretion where permitted, require appropriate legal process before releasing information.
Changes and severability
IP Link may modify this AUP at any time. Continued use of IP Link services after a modification constitutes acceptance of the revised AUP. A User who does not accept the revised AUP must stop using the affected services.
A failure to enforce any provision is not a waiver. If any portion of this AUP is found void, invalid, or unenforceable, the remaining provisions remain in effect. Applicable law supersedes only the conflicting provision or portion.
